Answered Date: Aug 23,2014 Title: Are the use of smileys/emoticons permissible?

Question Would use of emojis in SMS, Whatsapp, Viber, Telegram etc. constitute picture making (therefore impermissible) within the purview of Shar'iah?

Emojis are small digital images consisting usually of smiley faces used to express an emotion.

Answer In the Name of Allah, the Most Gracious, the Most Merciful. As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh. A smiley is a stylized representation of a smiling humanoid face, an important part of popular culture. The classic form designed in 1963 comprises a yellow circle with two black dots representing eyes and a black arc representing the mouth. On the Internet and in other plaintext communication channels, the emoticon form (sometimes also called the smiley-face emoticon) has traditionally been most popular, typically employing a colon and a right parenthesis to form sequences like :-), :), or (: that resemble a smiling face when viewed sideways. "Smiley" is also sometimes used as a generic term for any emoticon.[1] While emoticons/smileys originally started as a simple colon and parenthesis, it has gradually evolved into graphical images. Nowadays, on many mobile apps and emails etc., under the different names of smileys, emojis, stickers, it has developed into more human-like pictures. In some cases, these emoticons are animated pictures clearly depicting a live being. Even if one might be able to debate smileys/emoticons being a tasweer nowadays, due to its gradual development and changing and different forms, our opinion is that one should refrain from its usage (Saddan lilbaab). بسم الله الرحمن الرحيم

We begin with Allah’s blessed name, we praise him and we glorify him, seek his forgiveness and ask him to guide us. Whoever Allah guides, None can lead astray and whoever he misguides, None can guide. There is no power and no strength except from Allah, The most high, the Most great, the most powerful. We bear witness that there is no one worthy of worship but Allah Alone, and we bear witness that Prophet Muhammad (pbuh) is His slave-servant and the seal of His Messengers. We pray for peace and blessings on all the noble messengers and in particular on the last of them all “the blessed prophet Mohammad (pbuh)”

Narrated 'Aisha : I purchased a cushion with pictures on it. The Prophet (came and) stood at the door but did not enter. I said (to him), "I repent to Allah for what (the guilt) I have done." He said, "What is this cushion?" I said, "It is for you to sit on and recline on." He said, "The makers of these pictures will be punished on the Day of Resurrection and it will be said to them, 'Make alive what you have created.' Moreover, the angels do not enter a house where there are pictures.'" SAHIH AL-BUKHARI[Volume: 7 :: Book: 72 :: Hadith 840]

Abu'l-Hayyaj al-Asadi told that 'Ali (b. Abu Talib) said to him: Should I not send you on the same mission as Allah's Messenger (may peace be upon him) sent me? Do not leave an image without obliterating it, or a high grave without levelling It. This hadith has been reported by Habib with the same chain of transmitters and he said: (Do not leave) a picture without obliterating it. SAHIH MUSLIM [Book 4 : Hadith 2115]

Abu Zur'a reported: I visited the house of Marwan in the company of Abu Huraira and he found pictures there. whereupon he said: I heard Allah's Messenger (may peace be upon him) as saying: Allah, the Glorious and Exalted, said: Who is a more wrongdoer than one who tries to create creation like Mine creation. Let him create an atom or a grain of wheat or that of barley. This hadith has been transmitted on the authority of Abu Zur'a and he said: Abu Huraira went to the house of Sa'ld or Marwan which they had built in Medina and he (Abu Huraira) saw a painter who had been painting pictures in his house, whereupon he told that Allah's Messenger (may peace be upon him) had said like this, but he made no mention of the words:" Let him create the grain of barley." SAHIH MUSLIM [Book 24 : Hadith 5275]

Thus from the above guidance of our beloved prophet Mohammad (pbuh), a believer should neither make pictures nor should make use of them anyway. If one is involve in making or using of drawing of any animate creature, then one should absolutely abstain from it, otherwise there will be a severe punishment on the Day of Judgment.

However, if one wishes to draw pictures of unanimated objects (trees, buildings etc), then there is absolutely no harm.

Narrated by Said bin Abu Al Hasan While I was with Ibn 'Abbas a man came and said, "O father of 'Abbas! My sustenance is from my manual profession and I make these pictures." Ibn 'Abbas said, "I will tell you only what I heard from Allah's Apostle. I heard him saying, 'Whoever makes a picture will be punished by Allah till he puts life in it, and he will never be able to put life in it.' " Hearing this, that man heaved a sigh and his face turned pale. Ibn 'Abbas said to him, "What a pity! If you insist on making pictures, I advise you to make pictures of trees and any other unanimated objects." SAHIH AL_BUKHARI[Volume: 3 :: Book: 34 :: Hadith: 428]

Regarding the use of similes, stickers, emotions, cartoons etc., since these resemble or are the representation of human face, so it would be best for a believer to abstain from using them, otherwise one will suffer heavy punishment for it in Hell. Allah, the Glorious and Exalted, said: Who is a more wrongdoer than one who tries to create creation like Mine creation.

Thus, there is a great warning for those who make drawings or use them. If, in spite of knowing that this act is unlawful in Shariah, they do it on account of slackness on their part, they shall have to suffer heavy punishment for it in Hell. If they think that it is permissible in Islam, while it is forbidden, they would abide in Hell. May Allah save us from it. And Allah alone knows the best.

I ask Allah to make this a sincere effort, seeking his pleasure, and I ask him to grant us refuge in him from the evils within ourselves, and that in our deeds. I ask him to grant us success in achieving whatever pleases him; And May Allah Shower His blessings and mercy upon our beloved Prophet Muhammad (pbuh), his family and his Companions and on all those who follow him until the final hour.
